1. About Us

These Terms and Conditions (“Terms”) apply to all use of the Aquastar Cubicles website at aquastarcubicles.co.uk and to all orders placed with us for products and services.

Aquastar Cubicles is a specialist manufacturer of bespoke toilet cubicles, shower cubicles, vanity units, changing room systems, lockers and educational furniture. The majority of our products are manufactured to order to your specific requirements.

2. Acceptance of Terms

By accessing or using our website, or by placing an order with us, you confirm that you:

• Are at least 18 years of age
• Have the authority to enter into a binding contract on behalf of yourself or the organisation you represent
• Have read and agree to be bound by these Terms and our Privacy Policy

If you do not agree to these Terms, you must not use our website or place orders with us.

3. Using Our Website

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else’s use and enjoyment of the site.

You must not:

4. Quotations & Orders

Quotations

All quotations provided by Aquastar Cubicles are valid for 30 days from the date of issue unless otherwise stated in writing. After this period, prices may be subject to change due to material costs, lead times or other factors.

A quotation does not constitute a binding contract. A contract is only formed when we issue a written order confirmation following receipt of your order and, where applicable, your deposit payment.

Placing an Order

To place an order, please contact us by telephone or email. We will confirm your order in writing once we have agreed the specification, price and delivery requirements. Please review your order confirmation carefully. If any details are incorrect, notify us within 48 hours of receipt.

Order Specifications

It is your responsibility to ensure that all measurements, specifications, finishes and quantities provided to us are accurate. Aquastar Cubicles manufactures products to the dimensions and specifications you supply. We cannot accept liability for errors that result from incorrect information provided by you or your client.

5. Pricing & Payment

Prices

All prices quoted are in Pounds Sterling (GBP) and are exclusive of VAT unless otherwise stated. VAT will be charged at the prevailing UK rate and will be shown separately on your invoice.

We reserve the right to adjust prices prior to order confirmation in the event of significant changes in material costs, exchange rates or other circumstances beyond our control. We will notify you of any such change before processing your order.

Late Payment

Invoices not settled by the due date may be subject to interest at the rate of 8% per annum above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998. We also reserve the right to recover reasonable debt recovery costs.

6. Manufacture & Delivery

Lead Times

Estimated lead times will be provided at the time of quotation and confirmed in your order confirmation. Lead times are given in good faith but are not guaranteed. We will notify you as promptly as possible if circumstances arise that may affect your delivery date.

We cannot be held liable for any loss, cost or expense arising from delays in manufacture or delivery that are caused by circumstances outside our reasonable control (see Section 12, Force Majeure).

Delivery

Delivery is to the kerbside address specified at the time of order unless otherwise agreed in writing. It is your responsibility to ensure adequate access and unloading facilities are available at the delivery address. Additional charges may apply for failed deliveries or redeliveries where access is not available.

Risk in the goods passes to you upon delivery. Ownership of the goods remains with Aquastar Cubicles until full payment has been received.

Inspection on Delivery

You must inspect all goods upon delivery and note any visible damage or discrepancies on the delivery documentation before signing. Any claims for damage, shortages or incorrect goods must be reported to us in writing within 48 hours of delivery. Claims made after this period may not be accepted.

7. Bespoke Products & Returns

Cancellations

Orders may only be cancelled prior to the commencement of manufacture, and only with our written agreement. Where cancellation is agreed after manufacture has commenced, we reserve the right to charge for all costs incurred up to the point of cancellation, including materials, labour and overheads.

Returns & Defective Goods

We will not accept returns of bespoke, made-to-measure products unless they are:

• Defective due to a manufacturing fault on our part
• Materially different from the agreed specification

If you believe goods are defective or incorrect, please contact us within 48 hours of delivery with photographs and a written description of the issue. Where a valid claim is accepted, we will at our discretion repair, replace or refund the affected goods. We will not cover costs of third-party installation, removal or rectification works without prior written agreement.

8. Intellectual Property

All content on the Aquastar Cubicles website, including text, images, graphics, designs, logos, product photography and technical drawings, is the exclusive property of Aquastar Cubicles or its licensors and is protected by UK and international copyright law.

You may not reproduce, copy, distribute, modify or use any content from this website for commercial purposes without our prior written consent.

Any drawings, CAD files, designs or specifications produced by Aquastar Cubicles in connection with a quotation or order remain the intellectual property of Aquastar Cubicles, unless otherwise agreed in writing. You may use such drawings solely for the purpose of the project for which they were created.

9. Warranties & Disclaimers

Product Warranty

Our products are warranted to be free from defects in materials and workmanship under normal use and conditions. Specific warranty periods will be confirmed in your quotation or order confirmation. This warranty does not cover:

• Damage caused by misuse, neglect, accident or inappropriate installation
• Normal wear and tear
• Damage caused by failure to follow our care and maintenance guidelines
• Modifications made to goods by anyone other than Aquastar Cubicles

Our website is provided on an “as is” basis. While we make every effort to ensure that information on our website is accurate and up to date, we make no warranties, express or implied, regarding the completeness, accuracy or fitness for a particular purpose of any information published on this site.

Product images, colour swatches and finish samples are representative only. Actual colours and finishes may vary slightly due to monitor calibration and batch variation in materials. We recommend requesting physical samples before placing your order.

10. Limitation of Liability

To the fullest extent permitted by law, Aquastar Cubicles shall not be liable for:

• Any indirect, consequential, special or incidental loss or damage
• Loss of profit, revenue, business, contracts or anticipated savings
• Loss arising from the use of or inability to use our website or products
• Losses arising from errors in specifications, measurements or information provided by you

Our total aggregate liability to you in connection with any order or contract shall not exceed the total value of the goods or services supplied under that order.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be lawfully excluded under English law.

13. Governing Law & Disputes

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales.

Both parties agree to submit to the exclusive jurisdiction of the courts of England and Wales to resolve any dispute or claim arising in connection with these Terms or any order placed with us.

In the event of a dispute, we encourage you to contact us directly in the first instance. We are committed to resolving issues promptly and fairly where possible, without recourse to formal legal proceedings.

14. Changes to These Terms

We reserve the right to update or revise these Terms at any time. Where changes are material, we will update the “Last updated” date at the top of this page and, where appropriate, notify active customers by email.
